1.1 I&B Solutions grant you a non-exclusive, worldwide, non-transferable licence to use the Site in accordance with these Terms.

Any information that I&B Solutions received through this Site, other than your personally identifiable information covered by I&B Solutions’ Privacy Policy, will be deemed to be non-confidential.

I&B Solutions reserves all intellectual property rights including, but not limited to, copyright in material and/or services provided by it. - the replacement of the goods or the supply of equivalent goods;

- the payment of the cost of replacing the goods or of acquiring equivalent goods; or
- the payment of having the goods repaired, and
2. in the case of services:
- the supply of the services again; or
- the payment of the cost of having the services supplied again.

6.2 If a provision of these Terms is invalid or unenforceable it is to be read down or severed to the extent necessary without affecting the validity or enforceability of the remaining provisions.
6.3 These Terms are governed by the laws of Queensland, Australia, and each party submits to the jurisdiction of the courts of Queensland.

In this document: ‘I&B Solutions’ means Ice & Beverage Solutions Pty Ltd ACN 169 041 963; ‘Purchaser’ means the consumer of the products; and ‘product’ means any product sold and/or supplied by I&B Solutions in its ordinary course of business.
Each Purchaser acknowledges having received a copy of this document prior to their purchase of an I&B Solutions product and irrevocably agrees to the terms contained within.
Use of Products
I&B Solutions strictly makes no warranties as to the appropriateness and suitability of any I&B Solutions product for its intended use by Purchasers.
There are a variety of factors beyond I&B Solutions’ control that can affect the use and performance of an I&B Solutions product, including but not limited to the weather, natural disasters, accidents, fires, explosions, floods, chemicals, earth’s elements, labour or any other cause beyond the reasonable control of I&B Solutions.
Given the variety of factors that can affect the use and performance of an I&B Solutions product, I&B Solutions does not represent or warrant that I&B Solutions products are fit or suitable for all purposes and that it is each Purchaser’s responsibility to evaluate and determine whether an I&B Solutions product is fit for a particular purpose and suitable for the Purchaser’s method of application.
Reliability of Statements
All information, recommendations and other statements contained in this document, on I&B Solutions product packaging or other product literature are based upon tests or experience that I&B Solutions reasonably believes to be reliable, but I&B Solutions does not warrant or guarantee the accuracy or completeness of such information and statements.

Except where prohibited by law, I&B Solutions will not be liable for any loss or damage arising from an I&B Solutions product, whether direct, indirect, special, incidental or consequential, regardless of the legal theory asserted, including warranty, contract, negligence or strict liability.

I&B Solutions is not liable for physical or financial injury, loss or damage or consequential loss or damage of any kind arising out of the supply, layout, assembly, installation or operation of the Goods or I&B Solutions’ negligence or other act or omission.
Warranty & Limited Remedy
Unless additional warranties are specified on I&B Solutions product packaging or product literature, I&B Solutions warrant that each I&B Solutions product meets the applicable I&B Solutions product specification at the time the product was manufactured and shipped. If an I&B Solutions product does not conform to this warranty, then the sole and exclusive remedy is, at I&B Solutions’ absolute discretion, replacement of the I&B Solutions product or refund of the purchase price.
Except as provided for herein, all express and implied warranties, guarantees and conditions with respect to merchantability, description, quality, suitability or fitness of the product for any purpose, design, assembly, installation, material, workmanship or otherwise are expressly excluded.
